Removal of Mike DiMauro from Lawsuit (based on “bait & switch” tactics)
TRO_BRIEF – To remove Mike DiMauro from lawsuit vs NFL & Robert Kraft
The DOTW Co-Chairmen were approached by a Maine Attorney who was looking for us to help him in his quest to file his Class-Action Lawsuit against the NFL. Initially, we agreed to help, with one stipulation, that he remove his negative portrayal of Robert Kraft from his Brief and that he NOT include him or the Patriots in his suit. We remained involved until he pulled a ‘bait & switch’ by adding Robert Kraft as an opposing party at the very last minute. DOTW immediately withdrew our support and notified the Attorney that we were no longer interested, however, we were unable to notify one of our members, Michael DiMauro, before the attorney filed the suit the next morning.
A few days later, there was a whirlwind of negative press and sentiment for his cause, particularly for Mike DiMauro, over some of his quotes that the press picked up from his affidavit. Mike, who is Autistic, was distraught because of the negative press that was being directed at him, but more so, because he did not want Robert Kraft to be part of the suit. He turned to us for help and the leaders of DOTW wrote up a Legal Brief on his behalf, requesting that the Judge remove him from the suit on the grounds previously mentioned. On March 31 (2016), the judge released Mike DiMauro from the lawsuit.
Mike was also very upset over belittling comments made in the media, quoting from portions of his Affidavit. As a means to help ease his anxiety, we crafted a PRESS RELEASE on his behalf and blasted it out to local and national media sources and contacts. The Press release included an explanation that Mike had been purposely misled after agreeing to sign on the the suit as long as Robert Kraft was not named in the suit. Unbeknownst to Mike, the Attorney submitted a different Brief at the very last minute than Mike had agreed upon , which he later learned included Kraft as a Defendant. Mike’s story was reported by several LOCAL NEWS outlets as well as a couple of national media outlets.

On 2/17/2016, Jim Derochea was the guest on “Sports Wrap” with Michael Wigdor & Frank Walsh to discuss the filing of Jim’s Consumer Complaint with the MA AG’s Office, against the NFL in an effort to get the Patriots Draft Picks back.
The trio also discussed the accompanying Online Change.org Petition as well as the state of the Patriots and the NFL in general.
On 3/17/2016, Jim Derochea was the guest on “Sports Wrap” with Michael Wigdor & Frank Walsh for the second time, this time to give an update on the Consumer Complaint vs the NFL as well as the Online Change.org Petition which ultimately garnered 7,400 signatures.
The trio also discussed the affirming phone call that Jim had recently received from a close friend of Robert Kraft’s, who was asked to pass along Mr. Kraft’s gratitude and appreciation for going “above and beyond” to fight on the Patriots’ behalf. They also discussed the potential long term impact on the organization of losing two high draft picks, highlighting the importance of continuing to fight to get them back.
On 2/8/2017, three days after Super Bowl 51, Jim filled in for Frank Walsh as Guest Host, alongside Host Mike Wigdor on the weekly “Sports Wrap” show. Jim & Mike rehashed the Patriots improbable comeback, elaborating on the pivotal plays and attempted to capture the incredible emotion of the game in words.
They also touched upon the irony of the win with all that had gone on with Tom Brady and the team given his suspension for the alleged Deflategate scandal only to cap it off by executing the most historic, epic comeback in Super Bowl history! What a way to put an end to Deflategate AND the debate over who is the G.O.A.T., once and for all!
On 8/21/2016, Sheilla Dingus from the Defenders of the Wall was the guest on “Sports Wrap” with Michael Wigdor & Frank Walsh where she discussed how she got involved with the activist group. Sheilla discussed many of the group’s campaigns that had been executed up to that point as well as some insights into what the goals were for each as well as the group’s in general.
Sheilla also spent some time discussing some of the current legal cases that the NFL was involved in, including the fan’s lawsuit against the Hall of Fame Game organizers and the NFL itself.
